                Let us we all remember the historical International Workers day of May Day on 1st May 2017, which is remarkable for the achievement of eight hours of duty to working class.  I on behalf of our AISBCE Union convey my “May Day Greetings” to all comrades.

May Day Greetings

            In this May Day, we must realize the workers unity to make success our grievances and problems of our SBCO cadre. In our cadre, even though we have two Unions, basically, we are all gathered as one family with friendship in SBCO cadre first, after that only we are the members in two different Unions. It is nothing wrong having two Unions in one cadre subject to the function of our Union activities in sportive manner to bring our problems to the notice of administration.
Our Secretary [P] SRI.B.V.SUDHAKAR , Postal Board retired on superannuation on 30.04.2017.  I on behalf of our AISBCE Union wish for “A HAPPY and PROSPEROUS retired life”. SRI. ANAND NARAYAN NANDA, [IPS 1982 Cadre] is posted as Secretary [P] by the appointments Committee of the Cabinet. Our Union welcomes the new Secretary [P] to lead us with bright future.
 After taken charge as General Secretary of our Union, I have taken action with Directorate more than 75% of resolutions passed in the AIC held at Ajmer and the same has been published in this bulletin for your kind information. Shortly Sri.V.K.Mouriya, President, Sri.K.S.Keshav Rao, Asst.General Secretary and myself will visit to Delhi to meet the Secretary [P] and other senior officers on 11 & 12th May 2017  and discuss our problems particularly shortage of man power and imposing recovery & punishment with SBCO staff.
CONGRATULATIONS: Selvan J.V.Lshi abhraham [ 9 years] , S/O. Smt.B.Vimalarani, SBCO. Anna Road HO, Tamilnadu Circle won Gold & Bronze medal in “All India Karate tournament championship 2017 held at Delhi in 30.04.2017. Our Union appreciates J.V.Lshi abhraham for his best performance and also his mother Smt.B.Vimalarani. Congratulations to both of them.
32nd  HARYANA CIRCLE CONFERENCE: Sri.V.K.Mouriya, President and myselfI attended the Haryana Circle conference on 19.04.2017. Sri. Poonam Saini, Ambala city HO and Sri.Ajmer Singh , Panipat HO were elected as President and Circle Secretary respectively, Congratulations to the newly elected office bearers.
ALLOWANCES COMMITTEE REPORT: The committee on allowances headed by Sri.ASHOK LAVASA , Finance Secretary and Secretary [Expenditure] submitted its report to the Union Finance Minister Sri.Arun Jaitley. The report will now be placed before the Empowered Committee of Secretaries to firm up the proposal for approval of Cabinet. Let us be hope with favourable recommendations w.e.f. 01.01.21016.
WEST BENGAL COOB DIVISION SB FRAUD IN CRORES: Justice Jaya Das Gupta, CAT, Calcutta issued order on 21.04.2017 to the Chief PMG to issue full pension benefits to Sri.Haridas Das , Supervisor, SBCO immediately. Accordingly, full pension benefits paid to him on 29.04.2017.
AUDIT STATUS TO SBCO CADRE: The case filed at CAT, Calcutta under O.A.No: 350/00145/2017 ordered the Department of Post to submit its reply before 25.04.2017 and the case heard on 25.04.2017, It is ordered by the CAT that the Chief PMG, West Bengal circle will be the respondent through [MA] modified application. Kindly contribute your donation for the CAT expenses. Sub: Provision of sufficient staff to SBCO branch before imposing penalty  in case of frauds - reg
            I, as a newly elected General Secretary in the All India Conference held at Ajmer on 18 & 19.03.2017 wish to bring your kind notice about the major problem faced by the SBCO staff “Provision of sufficient staff to SBCO branch before imposing penalty in case of frauds”.
            As a newly elected General Secretary of our Union, first of all I and on behalf of our Union members wish to convey my Greetings to the Secretary [P] to step in various services to the public and assure to render our full co-operation to the Department for all efforts taken by your office in CBS operations &  India Post Payments Bank to serve a better service to our customers & publics with latest digital technology.
            It is a fact that there is acute shortage of staff in all SBCO sections in all the Circles. Some SBCO sections are running in single or in double hand. After implementation of CBS, it is clearly specified in the Directorate SB order No: 14/2015 dated 19.10.2015 to redeploy the SOSB branch staff to SBCO branches to manage the increasing work load. But, the Directorate order is not carried out and also no action has been taken to fill up the existing vacant posts and retirement vacancies.
 Now, the responsibility is put up with Divisional Heads to watch the voucher checking work in current position. As such, the Divisional Head is full responsible to provide sufficient staff to SBCO branch to keep the voucher checking work without any pending. If so, it is the responsibility of Divisional Head to provide sufficient man power to SBCO branch. If not provided, it is nature to happen some lapses during the voucher checking, since the entire branch work could not be carried out by  one, two or three PAs.
It is a simple logic that  a vehicle carrying load with 2 ton capacity could not carry load of 10 ton beyond the limit of the vehicles capacity. The same logic is also to be considered in SBCO branch. There is a habit in the Divisional administration that while demanding PA assistance, they will silent and in case of frauds they put the responsibility with SBCO staff and ordered for recovery and punishment.
Hence, our Union insists the administration to take action against the Divisional Heads for not carried out the Directorate orders to provide sufficient staff to SBCO. Instead of making recovery from the SBCO staff, it is kindly requested to make recovery from the Divisional Heads for not providing sufficient staff to SBCO branch, then only the Divisional Heads will take action to carry out the Directorate orders and provide staff assistance to SBCO branch.
All the recovery cases are to be reviewed that whether it is the responsibility of SBCO staff or non provision of assistant by the Divisional Head and necessary action has to be taken to refund the recovery in the genuine cases of non provision of staff to SBCO branch.
Our Union is put the following prayer for your kind consideration.
1.      All the Circle/Regional Heads are to be directed to ascertain the staff position of SBCO and the requirement of PA assistance according to the status of work.
2.      As per requirement, the PA assistance has to be provided as per the SB Order No: 14/2015 dated 19.10.2015.
3.      The In-charge, SBCO has to be authorized to write letters to the Divisional heads to enable them to put up their staff requirement liberally, since the demands put up to the Postmaster has not been considered and forwarded to the Divisional heads.
4.      If PA assistance has not been provided by the Divisional Heads and not carried out the Directorate orders to provide sufficient staff to SBCO, instead of making recovery from the SBCO staff, it is kindly requested to make recovery from the Divisional Heads for not providing sufficient staff to SBCO branch, then only the Divisional Heads will take action to carry out the Directorate orders and provide staff assistance to SBCO branch.
5.      All the recovery cases are to be reviewed that whether it is the responsibility of SBCO staff or non provision of assistant by the Divisional Head and necessary action has to be taken to refund the recovery in the genuine cases of non provision of staff to SBCO branch.
We are having full honor and respect with Divisional heads & senior officers. At the same time, there must be some sympathy and genuine reason for taken disciplinary action against with SBCO staff. Since, it is being not followed, our Union insists the above prayer to the Secretary [P] in the interest of service to keep the branch in current working status and avoid such future disciplinary action by imposing penalty recovery.

Sub: Request to issue clarification order to implement the Supreme Court SLP No: 4848/2016 Dt: 16.08.2016 and consider the MACP for all eligible officials-reg

         Our Union wishes to bring your kind notice about the recent Supreme Court judgement in the SLP No: 4848/2016 Dt: 16.08.2016 in favour of Sri.D.Sivakumar, RTD SPM to grant MACP w.e.f. 01.09.2008 and the Directorate’s order to implement the same vide Lr.No. No.2-19/2015-PCC Dt.01.03.2017.
                The intention of the Supreme Court judgement on the basis of above mentioned SLP, the promotions of the officials through Department competitive examinations should not be taken as a promotion for MACP. In our Department, most of the officials were promoted from lower grade to Postal Assistant and it was considered as one promotion and their MACP-III was declined to many officials and they have retired without availing MACP –III promotion.
                In one of the other Supreme court Special Leave Petition order vide No: 35654/2015 Dt: 13.02.2017, it is mentioned that “Learned counsel appearing for the Union of India, referring to the affidavit filed by the Joint Secretary, submits that on an overall view of justice, the Government of India has decided to extend the benefit of the judgment to all similarly situated persons. The article 141 of Indian constitution envisages that the judgement declared by the Supreme Court is binding to the similar cases also.
As such, our Union wishes to bring your kind notice about the recent Directorate order No: 22-612000-P. E. I (Pt.) Dt: 16.02.2017 on the directions by the Supreme Court in SLP No.35654/2015 to reconsider the TBOP/BCR revision for considering placement under TBOP/BCR Scheme in cases where seniors are considered for placement at par with their juniors with a direction to complete the process with a TIME BOUND manner.
                Likewise since, it is one of the welfare issue of the official’s MACP promotion, it is kindly requested to issue necessary clarification to extend the above Supreme court judgement to all officials MACP promotions without out counting the promotions through Department competitive examinations, as ordered in the SLP No: 35654/2015.

Sub: Constitution amendment in Part-III-Circle Union para No: 37.Circle working committee [iv] – Participation of Divisional Representative in the circle CWC meeting – Resolution approved by the General Body Meeting held at Ajmer on 18 & 19.03.2017.
            The resolution passed in the All India conference held at Ajmer on 18 & 19.03.2017, the following resolution has been passed by the General body meeting to add an sub para in the Constitution in Part-III-Circle Union para No: 37.Circle working committee [iv] – Participation of Divisional Representative in the circle CWC meeting.
Resolution No: 10 - Amendment in the Union constitution in para No: 37 – a sub clause (iv) as given below is approved by the General Body held at Ajmer on 18 & 19.03.2017.
(iv) - Since there is no branch Union at Divisional level, one Divisional Representative is nominated in each Division as per Union Constitution [ Para 36 (b) ii] to have a formal meeting with Divisional Heads. The Union Divisional representative may be attended in the Circle CWC meeting.
.           The above amendment may please be included in the Union constitution as Part-III-Circle Union para No: 37.Circle working committee – para [iv] as given below.
 [iv] . Since there is no branch Union at Divisional level, one Divisional Representative is nominated in each Division to have a formal meeting with Divisional Heads. Sub: Detection of SB fraud by the SBCO officials at Ghughumara SO under Coochbehar HO , West Bengal Circle to the huge amount of Rs. Rs.22639389/=       vide OM NO: 56 Dt: 10.03.2017 without any pay-in-slip – reg.
            I wish to bring your kind notice about the detection of SB fraud by the loyal SBCO official  Shri Haridas Das, Supervisor, [Retired on Superannuation 31.03.2017] & Shri Madhusudan Sutradhar,PA, SBCO, Coochbehar HO in West Bengal Circle to the huge amount raising   objection against the Ghughumari SO fraud to the amount of Rs. Rs.22639389/=  vide OM NO: 56 Dt: 08/10.03.2017.
            The fraud had been communicated to the  Divisional Head, Postmaster General, North Bengal Region and also to Chief Postmaster General, West Bengal Circle. After the action of the SBCO Supervisor, one investigation committee has been constituted by the Coochbehar Division  which is likely to act in favor of criminals involved in the fraud.  It is suspected that this fraud was happened with the help of the Postmaster, Coochbehar HO. It is seen that a large number of cheques involving 30/31/ 35 lakhs of Rupees, have been cleared by the Postmaster, CoochBehar HO  for a single account on  a single day.
            I h/w attach one list of fraudulent transactions without Pay-in-slip and the same has not been shown in hard copy of consolidated journal and SO account. While the objection was brought to the notice of Postmaster he misbehaved with the SBCO officials by throwing the copy of objection. Unless it was noticed by the loyal official, it will not be brought to the picture of administration about the huge amount of fraud made by cheques. It is not known the reason for the misbehave action of the Postmaster. Suppose he may be involved in this fraud case indirectly.
            Actually, the administration has to appreciate the action of the SBCO official, instead the official was ill-treated by the Postmaster. This branch staff strength is One Supervisor+ 4PAs, out of which only one Supervisor + one PA official is working.
            The official Sri. Haridas Das, Supervisor, SBCO, Coochbehar HO was due for retirement on 31.03.2017. The loyal official was threatened by the local administration to take disciplinary action under  Rule - 14 or Rule -9 at the time of his last service for retirement on 31.03.2017.
            In this huge amount of SB fraud, our Union wishes to bring the following for your kind notice to take action and avoid such kind of threatening of SBCO officials by the administration.
  1. The huge amount of SB fraud was detected by the SBCO staff and the objection was raised on 10.03.2017 and also communicated to the higher officers. It is the prime duty of the Supervisor and also as per the Directorate order SB Order No.14/2015  dated  at  ND-1  the  19.10.2015 para 5.3.1  - Any irregularity noticed will be entered in clear and concise words in the Register and copy of objection should be sent to Postmaster of HPO supported by printed copy of LOT/Finacle screen. The SBCO branch has to audit the SB work by raising objections for irregularities. But, the local administration including Divisional Head/Postmaster are against with SBCO staff for raising objections and they have shown their anti action with SBCO staff. This kind of atmosphere has to be changed, then only the SBCO staff could discharge their work properly.
  2. The staff strength of SBCO branch has to be monitored by the Divisional Heads with full strength of staff, otherwise in case of any lapses during frauds, the responsibility should be put with Divisional Head including the recovery of fraudulent amount.
  3. In the West Bengal Circle fraud detected by the SBCO staff, it is suspected that the local administration including the Postmaster may be involved in this fraud. Necessary disciplinary action has to be taken with them with proper investigation. It is better to form a investigation team at Directorate level to identify the real culprits.
  4. Necessary action has to be taken with the Postmaster for his misbehavior by throwing the copy of objections and also necessary instructions have to be issued to all Circles to avoid such kind of misbehavior, since this kind of misbehavior are happened in all Circles.
  5. It is suggested that the writing of CRs are to be brought under the control of Accounts officer, ICO [SB], then only the SBCO staff could discharge their auditing work properly.
  6. Whenever the frauds are being detected by the SBCO staff, they should have been appreciated for their loyal service.
Necessary instructions may please be circulated to all Heads of Circle for proper auditing work in SBCO branches.

REVISED TIME FACTOR FOR SBCO WORK UNDER CBS ENVIRONMENT: Our Union had already taken up this revised Time Factor for CBS work in SBCOs with your office vide CHQ D.O. Lr.No: AISBCEU/Time factor for SBCO CBS work/81-2016 Dated at Mumbai the 08.10.2016 and the same was acknowledged by your office Directorate vide Lr.No: 10-12/2016-SR the New Delhi-100001 dated 31.10.2016 addressed DDG [Estt] & [FS]. Early action is requested to consider the revised time factor and also to fill up all the vacancies of the year 2015 & 2016. Until further orders from Directorate, necessary instructions may please be given to all Circles to provide PA assistance as directed in the SB order No. 14/2015 dated 19.10.2015 and subsequent letter No. 25-11/2016 – SB Dated 10/11.05.2016,  25.05.2016, 10.06.2016 and SB Order No. 06/2016 dated 21.06.2016.

CADRE RESTRUCTURE: Cadre restructuring of SBCO cadre should be taken on priority basis. The designation of SBCO staff should have been changed as Auditor, since their nature of work is auditing the Savings Bank transactions only. In many SBCOs, most of the junior officials are working as Supervisors in the LSG/HSG I & II posts. Hence after cadre restructure, it is kindly requested to fill up all the vacant Supervisor posts as per seniority on one time measure as ordered in the past and also, it is kindly requested to fill all the PAs vacancy of the year 2015 & 2016 as early as possible.

Sub: Divisional Heads direction to SBCO staff to attend the unauthorized SB works.

                Our Union had already brought your kind notice about the direction of Divisional Heads to the SBCO staff apart from rules and procedure. The following unauthorized works are directed the SBCO staff, simply they ignore the responsibility of the SB branch staff. Even though, the SOSB branch is wind up, still the SB branch is functioning at  HO level.
Our Union wish to bring your kind notice about the recent  Directorate Order vide No.25-11/2016-FS-CBS Dated 10.06.2016 vide para 4 that Transfer of account from one CBS PO to another CBS PO should be carried out at HO only. If any application for transfer is submitted at any CBS SO, that SO has to verify genuineness of the customer by taking fresh KYC documents (if required). Application should enter in a register to be maintained in manuscript and forward with KYC documents to its HO for transfer of account. In HO, one designated PA should transfer the account and Supervisor has to verify the same.
I wish to bring your kind notice about the Divisional Heads direction to SBCO staff to attend the following unauthorized SB works.
  1. Settlement of Objections: As per the Directorate order SB Order No.14/2015  dated  at  ND-1  the  19.10.2015 para 5.3.1 Any irregularity noticed will be entered in clear and concise words in the Register and copy of objection should be sent to Postmaster of HPO supported by printed copy of LOT/Finacle screen.
Regarding Objection settlement, it is clearly directed the SBCO staff that this branch has to maintain OM Registers and copy of the OM has to be send to the Postmaster and in case of pending more than 30 days, it should be brought to the notice of Divisional Head. But, instead of the above instructions, the SBCO officials are directed by the Divisional Heads to visit sub-office to settle the OMs and the entire settlement work responsibility is put with SBCO staff. i.e. the SBCO branch has to audit the SB work by raising objections for irregularities and the same SBCO audit staff has to take action to settle the OMs. It is against the concept of audit wing. However, the SBCO branch will render guidance for the settlement of OMs.
8.       Verification of withdrawals of  Rs. 10000/- and above in savings accounts at branch offices and single handed sub offices POSB Vol Part-I Rule: 85:- As and when any withdrawal of Rs. 10000/- and above in savings account standing at a branch post office, Extra-Departmental Sub Post Office, or single handed sub post office , the ledger Assistant of the Head Post Office  will prepare a verification memo to forward it to the Sub Divisional Inspector of Post Offices or Public Relations Inspector who will verify the withdrawal by contacting the depositor. Since the SOSB branch is wind up, the SBCO staff is directed to prepare the above list.  
The SBCO staff is directed by the Divisional Heads to prepare the above list. Actually, it is not the duty of SBCO work, since they have no time due to the increased work load, acute shortage of vacant post and non implementation of Directorate orders to provide PA assistance from the surplus strength of SOSB staff.
  1. Calculation of penal interest to the amounts defrauded from SB accounts POSB Vol Part-I Rule: 84 [4]:-.  The amount of penal interest will be calculated by the head office and intimated to the punishing authority after check by the Control Organisation.  it will be necessary that the interest on the amount paid excess should be calculated by the HO for accounts closed at the sub and branch offices in order to ensure accuracy.
The SBCO staff is directed to calculate the penal interest directly. The intention of the above order for second check by the SBCO staff, there may be chances for mistake in the calculation interest due to human error. Hence, one of the PA from HO branch has to calculate the penal interest first, after that the second check will be done by SBCO staff. Necessary instruction is required in this penal interest calculation method.
Our Union wishes to bring your kind notice about our nature of duties as Post Audit work for which it is originated from A.G, P & T audit. The Savings Bank Control Organization has been set up in each Head Post Office to maintain control accounts of Savings bank and carry out day-today checks of the work done by the SB Branch
The SBCO staff should not be directed to attend the primary work of SB branches, since they are identified for the post audit work i.e. secondary work of SB branches. If an audit wing is directed to attend the primary work, and later on the same audit wing is directed to attend its earlier work, there is no meaning of audit function.
Just like, it is kindly requested to issue necessary instructions to all Heads of Circles not to direct the SBCO staff which is not authorized SB work to SBCO staff, instead one of the PA from HO branch may be designated to attend the following type of works.
1.       On receipt of copy of objection from SBCO branch to Postmaster of HPO supported by printed copy of LOT/Finacle screen, the follow up action has to be taken with sub office to settle the OMs.
2.      Calculation of penal interest to the amounts defrauded from SB accounts by the HO branch and the same may be sent to SBCO for second checkup.
3.      Verification of withdrawals of  Rs. 10000/- and above in savings accounts at branch offices and single handed sub offices POSB - the ledger Assistant of the Head Post Office  will prepare a verification memo to forward it to the Sub Divisional Inspector of Post Offices or Public Relations Inspector who will verify the withdrawal by contacting the depositor.
4.      Any other miscellaneous SB work ordered by the Postmaster/Divisional Head.
Necessary instructions may please be issued to all Heads of Circles not to engage the SBCO staff for the above type of works and it is kindly requested to designate one of the PA from HO to attend the above type of works.

                But, in some circles the SBCO branch is directed to send the both statistical and financial information to PAO. After CBS, financial information will not come in to picture since all the SB accounts under CBS were centralized. In case, the PAO wants to get the Circle information, it could be generated through Circle ID through Circle CPC Units.

                I wish to bring your kind notice about the problems faced by the Supervisor, SBCO branches to take up their staff matters with Divisional head.
                As per the existing instructions, the SBCO branch Supervisor should not write correspondences directly to the Divisional Head. We may agree it other than the staff matters, since every correspondence in connection staff matters has to be routed through the Postmaster only and they are not co-operated with SBCO branch ,
                Recently, the Directorate had issued several orders to provide Postal Assistant to SBCO branch for LOT voucher checking and other works in connection with CBS. Unless the Supervisor, SBCO is authorized to write correspondences directly to the Divisional Heads regarding staff matters i.e. [provision of additional hands] with a copy to the Postmaster and Accounts Officer [ICO/SB], the SBCO branch could not carry out the Directorate instruction to complete the day to day work. Then only, the Supervisor, SBCO could give the clear picture about the quantum of work and staff requirements to the Divisional head. Otherwise, it could not be possible to fix the responsibility with SBCO staff in case of frauds. Now the responsibility is fixed with Divisional Heads as given below vide SB Order No:5/2016 Dt: 21.06.2016.  
.  “Para.14. Divisional Heads should ensure that SBCO staff is comparing LOT generated through MIS server with the vouchers received from SO/HO. Wherever, there is shortage of staff in SBCO, necessary help should be provided from Post Office staff to SBCO (spared from SBSO branch) to complete voucher checking. Voucher checking should not be in arrears for more than 2-3 days. It will be responsibility of Divisional heads to ensure that adequate staff are provided”.
                Hence, it is kindly requested that all the Supervisors of SBCO branch may please be permitted to address correspondences directly to the Divisional Head in connection with staff matters only [quantum of work and staff requirements]. Then only, it could be possible to carry out the Directorate guidelines in connection with CBS work to prevent frauds and maintain the branch w/o arrears.
